These Terms of Service (“Terms”) form a binding agreement between you (or the entity you represent) and Kairav Bhatia, sole proprietor trading as Pipebit (“we”, “us”), the operator of Pipebit Converse. If you use the Service on behalf of an organisation, you represent that you are authorised to bind it.
2. The Service
Pipebit Converse provides AI-powered automation for customer conversations on the WhatsApp Business Platform, including support automation, lead qualification, and integrations with third-party tools such as CRMs. Features, plans, and limits are described on our website and may change over time.
3. Accounts and eligibility
- You must provide accurate information and keep your credentials secure.
- You are responsible for all activity under your account.
- The Service is intended for business use by users aged 18 or older.
4. Acceptable use
You agree not to use the Service to:
- Send spam, unsolicited, or unlawful messages, or violate any opt-in/consent requirements.
- Infringe intellectual property or privacy rights, or transmit malware.
- Attempt to disrupt, reverse engineer, or gain unauthorised access to the Service.
- Violate applicable laws or the terms of any connected platform.
5. WhatsApp and third-party platforms
Your use of WhatsApp through the Service is additionally governed by Meta's and WhatsApp's applicable terms and policies (including the WhatsApp Business Terms and Messaging Policy). You are responsible for complying with them and for obtaining any required consent from your end-customers. WhatsApp conversation charges set by Meta are billed at cost. We are an independent product and are not affiliated with or endorsed by WhatsApp LLC or Meta Platforms, Inc.
6. Fees and billing
Paid plans are billed in advance on the cycle shown at purchase. Prices shown on the website are indicative and exclusive of taxes (such as GST) and of WhatsApp conversation charges billed by Meta, unless stated otherwise. Fees are non-refundable except as required by law or expressly stated.
7. Third-party integrations
The Service can connect to third-party services (e.g. CRMs, payment tools). Your use of those services is governed by their own terms, and we are not responsible for third-party services.
8. Intellectual property
We and our licensors own all rights in the Service. You retain ownership of the content and data you provide (“Customer Data”) and grant us a limited licence to process it solely to provide and improve the Service in accordance with our Privacy Policy.
9. Privacy
Our handling of personal data is described in our Privacy Policy. Where we process personal data on your behalf, we do so as your processor under a data processing agreement.
10. Disclaimers
The Service is provided “as is” and “as available”. AI-generated responses may be inaccurate and should be reviewed where appropriate. Any metrics, estimates, or calculators on our website (including ROI estimates) are illustrative only and are not guarantees of results. To the maximum extent permitted by law, we disclaim all implied warranties.
11. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, or consequential damages, and our aggregate liability arising out of or related to the Service is limited to the amounts you paid us in the twelve (12) months preceding the claim.
12. Indemnity
You agree to indemnify us against claims arising from your Customer Data, your use of the Service, or your breach of these Terms or applicable law, including messaging and consent laws.
13. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or applicable platform policies. On termination, your right to use the Service ends; certain provisions survive by their nature.
14. Governing law
These Terms are governed by the laws of India, and the courts at [insert city, India] have exclusive jurisdiction, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.
